will 265/40-17 rub on rear? I have H&R/Bilstein.

It should be OK. BMW specced 255/40 for the 17x9 M5 wheel as Michelin produced an extra tall MXX2 tyre. So 265/40 probably matches the fronts better. Some M5 owners in the States run 275/40 as apparently this is the stock mustang/camaro size so more choice.

I should also add that you should check if there are registration/legal and insurance ramifications.

Do they fit up front too? I'm going to be picking up a new set of wheels and would love to be able to use this size, as there are some great tires I'd like to get that are only available in 275/40-17.

The M5 fronts are 17 x 8 and the spec tyre is 235/45 though some guys run 245/45.
I quite like the staggered look.
If you put on 275/40's on the rear, you may need to get the lip rolled. To match, you should use 245/45 fronts.

i have 235 / 17 front and 255 / 17 rear
i had rubbing in the rear until i rolled the fenders
now even with sachs kits its fine
the car understeers like stupid though
i made a mistake, don't make the same
one .... it looks good though =]
